- Since March 2024 there is no floorspace cap and no vacancy requirement — larger and still-occupied buildings now qualify, so you can collect rent while preparing the application

Considerations
- Class MA conditions still apply: building must have been in lawful Class E use for at least 2 years, subject to prior-approval tests (flooding, contamination, noise, light, transport) and minimum room-size standards
- Article 4 Directions can switch the right off in some areas
- Class MA is a change-of-use right only — external/structural works need separate full planning
- Structural, services and fire-safety works can be costly; requires vacant possession to build out
- Valuation gap and financing during the works phase
